General Terms and Conditions (GTC) of Artemis Synergy GmbH for Customers

1. Scope

The following General Terms and Conditions govern the contractual relationship between Artemis Synergy GmbH (hereinafter referred to as “Contractor”) and its customers (hereinafter referred to as “Client”) with regard to the placement of freelance and permanent specialists and managers.

 

2. Subject matter of the contract

The contractor undertakes to conduct the search and selection of suitable specialists and managers on behalf of the client. The client grants the contractor the right to conduct contract negotiations with potential candidates on its behalf and at its expense.

 

3. Scope of services

The Contractor will conduct the search for suitable candidates based on the requirement profiles provided by the Client. The Contractor will make every reasonable effort to find qualified candidates. However, the Contractor does not guarantee the successful placement of specialists and managers.

 

4. Fee

A fee is agreed upon for the contractor's brokerage services. The amount of the fee is based on the agreed terms and conditions and will be communicated to the client before the brokerage services begin. See framework agreement.

 

5. Confidentiality

The contractor undertakes to treat all information received in the course of the brokerage activity as confidential and to use it exclusively for the agreed purpose. Information will only be passed on to third parties with the express consent of the client.

 

6. Liability

The contractor is only liable for damages resulting from gross negligence or intent. Liability for indirect damages or lost profits is excluded. The client is obligated to provide the contractor with all necessary information and documentation to enable successful brokerage activities.

 

7. Contract duration and termination

The agency agreement is concluded for an indefinite period. Both parties have the right to terminate the agreement at any time without giving reasons. Services already rendered and costs incurred are to be reimbursed by the client.

 

8. Final provisions

The law of the Federal Republic of Germany applies. The place of performance and jurisdiction for all disputes arising from this contract is the registered office of the Contractor. Should individual provisions of these General Terms and Conditions be or become invalid, this shall not affect the validity of the remaining provisions. The invalid provisions shall be replaced by a provision that most closely approximates the economic purpose of the invalid provision.

1. Scope

The following General Terms and Conditions govern the contractual relationship between Artemis Synergy GmbH (hereinafter referred to as the "Contractor") and candidates (hereinafter referred to as the "Applicants") who wish to be placed by Artemis Synergy GmbH. Either in the project area or  für Anstellungen im Festanstellungsbereich.

 

2. Subject matter of the contract

The contractor undertakes to search for suitable job offers or projects on behalf of the applicant and to assist the applicant in their placement. The applicant grants the contractor the right to conduct contract negotiations with potential employers on their behalf and at their expense.

 

3. Scope of services

The Contractor will conduct the search for suitable job openings or projects based on the qualifications and preferences provided by the applicant. The Contractor will make every reasonable effort to find suitable job openings. However, the Contractor does not guarantee successful placement.

 

4. Fee

The applicant shall not incur any costs or fees for the contractor’s placement activities.

 

5. Confidentiality

The contractor undertakes to treat all information received during the placement process as confidential and to use it exclusively for the agreed purpose. Information will only be passed on to third parties with the applicant's express consent. This consent is granted upon confirmation of data protection.
